Terms of Service

Last updated: October 11, 2026

These Terms of Service ("Terms") govern your access to and use of the Menuhaat website and mobile application (together, the "Service") operated by Menuhaat ("Menuhaat", "we", "us", or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements and that the information you provide is accurate and complete.

2. Accounts and Security

To use certain features you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from your failure to safeguard your credentials.

3. Use of the Service

Menuhaat provides tools to create and manage digital QR code menus, publish content, receive orders, and accept payments. You agree to use the Service only for lawful purposes and in accordance with these Terms.

You agree not to misuse the Service, including by attempting to gain unauthorized access, interfering with its operation, uploading malicious code, or using it to infringe the rights of others.

4. Your Content

You retain ownership of the menus, images, text, and other content you upload ("Your Content"). You grant us a non-exclusive, worldwide license to host, store, display, and distribute Your Content solely as needed to operate and provide the Service.

You are responsible for Your Content and represent that you have all rights necessary to publish it and that it does not violate any law or third-party right.

5. Subscriptions and Billing

Some features of the Service are offered on a paid subscription basis. By subscribing, you authorize us or our payment processors to charge the applicable fees to your chosen payment method on a recurring basis until you cancel.

Fees are stated at the time of purchase. Unless otherwise required by law or stated at purchase, fees are non-refundable. We may change our fees with reasonable prior notice.

6. Online Payments

The Service supports online payments through third-party payment gateways. By making or accepting payments, you agree to the terms of the relevant payment gateway. Your card details are stored and processed by these PCI-DSS compliant gateways; we do not store any credit card information on our servers or databases.

We are not responsible for errors, delays, or losses caused by payment gateways, banks, or financial institutions. You are responsible for providing accurate payment and payout information.

7. Orders and Transactions

Where the Service facilitates orders between diners and restaurants, the contract for the sale of food or goods is between the diner and the restaurant. Menuhaat provides the technology platform and is not a party to that contract.

Restaurants are responsible for fulfilling orders, honoring prices, and complying with applicable food safety, tax, and consumer protection laws.

8. Intellectual Property

The Service, including its software, design, logos, and trademarks, is owned by Menuhaat and protected by intellectual property laws. These Terms do not grant you any right to use our branding without prior written permission.

9. Third-Party Services

The Service may integrate or link to third-party services. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.

10. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, create risk or legal exposure for us, or if we discontinue the Service.

Upon termination, your right to use the Service ends. Provisions that by their nature should survive termination will continue to apply.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

12. Limitation of Liability

To the maximum extent permitted by law, Menuhaat will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from your use of or inability to use the Service.

Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months preceding the claim.

13. Indemnification

You agree to indemnify and hold Menuhaat harmless from any claims, damages, liabilities, and expenses arising from your use of the Service, Your Content, or your violation of these Terms or any law or third-party right.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which Menuhaat operates, without regard to conflict of law principles. Any disputes will be subject to the exclusive jurisdiction of the competent courts of that jurisdiction, unless otherwise required by applicable law.

15. Changes to These Terms

We may update these Terms from time to time. We will post the updated version with a revised "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

16. Contact Us
